2. Use of the Services

Subject to your compliance with these Terms, WonderspacED grants you a limited, non-exclusive, non-transferable, revocable permission to access and use the Services for personal, non-commercial, educational purposes only. This permission does not grant ownership of any content or intellectual property, and all rights not expressly granted are reserved by WonderspacED.

You agree to use the Services only in accordance with all applicable local, national, and international laws and solely for lawful, educational purposes.

You specifically agree that you will not:

• Violate any applicable law, regulation, or third-party right, including data privacy and intellectual property laws.
• Access or attempt to access unauthorized parts of the Services, including circumventing content filters, authentication protocols, or security systems.
• Reproduce, copy, adapt, translate, modify, decompile, reverse engineer, disassemble, or attempt to extract source code or underlying structure of any part of the Services without WonderspacED’s prior written consent.
• Use the Services in a manner that interferes with, disables, disrupts, or overburdens their functionality or performance, or associated systems and networks.
• Upload, post, transmit, or make available any unlawful, abusive, harassing, defamatory, obscene, fraudulent content, or content that promotes illegal or harmful activities.
• Distribute or share login credentials, allow others to access your child or pupil’s account, or use another user’s account without authorization.
• Use the Services for any commercial purpose, including reselling access, offering paid training, or exploiting the platform for advertising, sponsorships, or promotions without prior written approval.
• Introduce any viruses, worms, trojan horses, or other malicious code, or otherwise compromise the integrity or security of the Services.

WonderspacED reserves the right to suspend, restrict, or terminate your access if it believes you have violated these Terms or pose a threat to the safety or integrity of the platform or its users.

3. Content Ownership and License

All materials available through WonderspacED Services, including text, graphics, curriculum, interactive features, animations, audio, videos, software, tools, design elements, data compilations, and the overall appearance of the platform, are the exclusive property of WonderspacED. All such rights are expressly reserved.

If you voluntarily submit any ideas, suggestions, proposals, feedback, or materials, you acknowledge that such feedback is non-confidential and non-proprietary. WonderspacED is free to use such feedback without limitation or obligation for any purpose, commercial or otherwise, without compensation to you. You grant WonderspacED a non-exclusive right to use, reproduce, and display such feedback to provide and improve the Services.

The WonderspacED Services may contain links to or integrations with third-party websites, software, platforms, tools, applications, plug-ins, services, or content not owned, controlled, or operated by WonderspacED. These are provided for convenience or to enhance user experience.

Use of Third-Party Services:

When you interact with these services, you do so at your own risk, and your use is governed by the respective third party’s terms and conditions and privacy policies.

Disclaimer of Responsibility:

WonderspacED does not endorse, monitor, vet, or control any third-party services and expressly disclaims all liability related to your use thereof.

• We make no representations or warranties regarding the content, legality, accuracy, functionality, or safety of any third-party services.
• We are not responsible for any loss, damage, harm, or data breach resulting from your use of or reliance on any third-party content, services, or technologies accessed via our platform.
• Your interactions with third parties, including any transactions, data sharing, or disputes, are solely between you and the applicable third party, and you agree to release WonderspacED from any claims arising from such interactions.

Third-Party Tools Integrated into the Platform:

We may integrate third-party software tools or services directly into the WonderspacED platform (e.g., analytics providers).

• Such tools are provided “as is” without any warranties or guarantees.
• We do not assume liability for their performance or compliance with applicable laws.
• Your use of those tools may result in data collection or transmission to the third-party provider, and such use is subject to their privacy and data handling practices, not ours.

External Linking Policy:

Links from WonderspacED to external websites do not constitute endorsement or approval of those websites or their content. WonderspacED is not responsible for the maintenance, availability, or accuracy of any external website linked from the Services. We encourage you to read the terms of service and privacy policies of any third-party websites or services you visit through links from the WonderspacED platform.

5. Privacy

Your access to and use of the Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy outlines how WonderspacED collects, uses, discloses, stores, and safeguards your personal information, including information collected from or about children.

By using the Services you:

• Acknowledge that you have read and understood the Privacy Policy.
• Consent to the collection, use, processing, and disclosure of personal information as described therein.
• Agree that WonderspacED may process your data in accordance with applicable privacy and data protection laws.
• Acknowledge that additional consents may be required under local or international law (such as verifiable parental consent), and that you are responsible for obtaining those consents where applicable.

WonderspacED is committed to protecting the privacy and security of our users, especially children, and implements technical and organizational measures to safeguard personal information. If you do not agree with our Privacy Policy or any part of it, you must not access or use the Services.

6. International Use

WonderspacED is owned and operated from Ghana, and its infrastructure is hosted and maintained in accordance with Ghanaian laws. If you access or use the Services from outside Ghana, you do so at your initiative and are solely responsible for ensuring compliance with local laws, regulations, and restrictions, including laws concerning:

• Data privacy and protection
• Content accessibility
• Export and import controls
• Educational and child protection regulations

By accessing or using the Services from outside of Ghana, you expressly acknowledge and agree that:

• Your information may be transferred to, stored in, and processed in one or more countries, including countries that may not offer the same level of data protection as your home jurisdiction.
• You consent to such cross-border transfers, including the transmission of personal data subject to international data protection laws.
• WonderspacED makes no representation that the Services, or any features or content therein, are appropriate or available for use in your jurisdiction.
• If you are a parent, legal guardian, or educational institution located outside Ghana, it is your responsibility to ensure that any use by or on behalf of children complies with the applicable laws of your jurisdiction.

Where required by law, WonderspacED will implement appropriate data transfer safeguards to ensure that personal information transferred internationally receives adequate protection. Use of the Services in violation of applicable local laws or jurisdictions subject to legal restrictions is strictly prohibited.

7. Inactive Accounts and Termination of Use

Inactivity:

For security and integrity, WonderspacED may automatically log users out of their accounts after prolonged inactivity. This helps protect user information and prevent unauthorized access, especially when devices are shared or used in public settings. Automatic logout does not delete your account or associated data; you may log back in at any time, provided your account remains active.

However, WonderspacED reserves the right to take further action on inactive accounts, including:

• Deactivating or archiving accounts that remain unused for extended periods (e.g., 12 months or more).
• Sending periodic reminders to verify or update your account information.
• Deleting non-subscribed or dormant accounts after multiple failed contact attempts, in accordance with our data retention and deletion policies.

Suspension and Termination by WonderspacED:

We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, deactivate, or permanently terminate your access to some or all of the Services at any time if we believe that:

• You have violated or breached any provision of these Terms of Use.
• Your conduct has or may negatively impact the safety, experience, or rights of other users (especially children).
• Your account is being used in a manner that poses a risk to the integrity or operation of the Services.
• We are required to do so by law, regulation, or a lawful government or judicial request.
• Continuing to provide Services to you could result in legal liability for WonderspacED.

In the event of termination:

• Your permission to use the Services is immediately revoked.
• Your access credentials will be disabled, and your account and data may be deleted in accordance with our data retention policy.
• WonderspacED is not liable to you or any third party for any loss of access, data, or functionality resulting from the suspension or termination of your account.

User-Initiated Termination:

You may discontinue use of the Services and request account deletion at any time by contacting us at [Insert Contact Email]. Upon verified request, WonderspacED will delete your account and associated personal information within a reasonable time, subject to legal obligations requiring continued retention.

Survival of Terms:

The sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provision which by its nature is intended to survive termination, shall survive termination of your use of the Services.

8. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

The Services, including all content, features, educational materials, software, user interfaces, and related functionality, are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by applicable law, WonderspacED and its affiliates and service providers expressly disclaim all warranties, representations, guarantees, and conditions of any kind, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, title, accuracy of data, quiet enjoyment, and non-infringement.
• Any warranty that the Services will meet your requirements or expectations.
• Any warranty that the Services will be uninterrupted, secure, timely, reliable, current, complete, accurate, or error-free, or that any defects or errors will be corrected.
• Any warranties that user-submitted content, progress tracking, or educational results are guaranteed, validated, or endorsed by any educational authority or institution.
• Any warranties arising from usage of trade, course of dealing, or course of performance.

WonderspacED does not guarantee that the Services will be compatible with your devices, free from viruses, malware, or other harmful components, or that data or communications transmitted through the platform will be secure or free from unauthorized access. No oral or written information or advice provided by WonderspacED, its employees, agents, or representatives shall create any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, the warranties provided will be limited to the minimum required by applicable law.

9. Limitation of Liability

To the fullest extent permitted by law, in no event shall WonderspacED, its affiliates, officers, directors, employees, contractors, agents, successors, or assigns be liable to you or any third party for any damages arising out of or relating to your access to, use of, or inability to use the Services, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

This includes, but is not limited to:

• Indirect, incidental, consequential, special, exemplary, or punitive damages, even if we have been advised of the possibility of such damages.
• Loss of data, revenue, business opportunities, educational progress, anticipated savings, profits, or goodwill.
• Personal injury, emotional distress, or reputational harm resulting from your use of the Services or reliance on any content.
• Any interruption, suspension, or termination of access, including damages incurred by reason of service interruptions, system failures, data breaches, or software bugs.

In all cases, WonderspacED’s total cumulative liability to you for any claims arising from or related to the Services shall not exceed the greater of:

• The total amount you paid to WonderspacED, if any, for use of the Services during the twelve (12) months immediately preceding the event giving rise to the liability.
• Or Five Hundred Ghana Cedis (GHS500.00) or the equivalent amount in your local currency.

This limitation applies regardless of the form or nature of the claim or cause of action, and whether such damages were foreseeable or not.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such cases, the above limitations shall apply to the maximum extent permitted by applicable law, and any remaining liability shall be strictly limited to actual direct damages incurred.

10. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless WonderspacED, its affiliates and service providers, and each of their respective officers, directors, employees, contractors, agents, successors, and assigns from and against any claims, demands, actions, proceedings, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees and legal costs), arising out of or in any way connected with:

• Your access to, use of, or misuse of the Services.
• Your breach or violation of these Terms or any applicable law or regulation.
• Any content you submit, post, transmit, or otherwise make available through the Services.
• Your infringement or misappropriation of any third party’s intellectual property rights, privacy rights, or other proprietary or legal rights.
• Any interaction, transaction, or dispute between you and a third party in connection with the Services.

11. Changes to Terms

WonderspacED reserves the right to modify, revise, or update these Terms of Use at any time, in its sole discretion, to reflect changes in applicable laws and regulations, technological developments, business practices, and/or features, services, or functionalities of the Services. The “Last Updated Date” at the top of these Terms will indicate the date the current version was published.

By continuing to access or use the Services after changes become effective, you acknowledge and accept the updated Terms and agree to be bound by the revised Terms as of their effective date. If you do not agree to the modified Terms, you must immediately stop using the Services and may request account deletion. We encourage you to review these Terms periodically to stay informed about your rights and obligations as a user.

These Terms of Use, together with our Privacy Policy and any other legal notices, policies, or guidelines published by WonderspacED, constitute the entire and exclusive agreement between you and WonderspacED regarding your access to and use of the Services.

12. Governing Law and Dispute Resolution

These Terms of Use, and any dispute or claim arising out of or relating to them, the Services, or your use of the Services, shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of laws principles.

If you are accessing the Services from outside of Ghana, you are solely responsible for compliance with your local laws and regulations to the extent they apply, and you do so at your own risk. Any disputes arising out of the use of this Platform shall be subject to the exclusive jurisdiction of the courts of Ghana.

14. Notice to Schools and Educators

If you are using WonderspacED on behalf of a school, you represent and warrant that you are authorized to do so and that you have the authority to agree to this Privacy Policy on the school’s behalf. You further represent that you have obtained all necessary parental or legal guardian consents for the collection and use of personal information from students, as required by applicable data protection and privacy laws in your jurisdiction.
